Despite the general consensus about freedom of expression being a basic fundamental right on every democratic society, the debate about its boundaries has never found such a pacific agreement. Thus, the Spanish Penal Code has several articles that punish its abuse that are highly contested, like articles 490.3 and 543 that penalize the offenses directed towards national symbols or State representatives. This presentation is concerned with a first introductory study devoted to internal frictional dissipation modelling of cracked materials. The problem is set as periodic Representative Volume Element (RVE) with oriented cracks diffused in the bulk material. As first stage, useful for moderate loading levels, cracks are considered fixed and stable at certain position and are modelled as perfect frictional mechanical interface with unilateral contact features. In this paper the author elaborates on reflections about the role of the referendum in the British legal system, well-known to be characterized by a representative democracy, with the intent to examine the evolution of this institute. It is also a comparative study which examines the effects of the consultative referendum in the Spanish legal system and the characteristics and the effects of the legislative referendum in the French legal system in order to identify the analogies and the differences among these referendum.
